I am still the Chairman of the APGA — Oye

Dr Victor Oye, National Chairman of the All Progressives Grand Alliance (APGA), says his position as the party’s chairman is not in question because the Supreme Court has not issued a new ruling on the matter.

Oye stated this at a press conference in Abuja on Friday.
He stated that the briefing was held to clarify rumours that the Supreme Court had issued a new ruling on the chairmanship dispute between himself and Mr Edozie Njoku, which was settled on October 14, 2021.

He claimed that the Supreme Court only convened on Friday to correct a clerical error.

He claimed that after a judgement purportedly confirming the factional National Convention of the APGA held in Owerri, Imo, he petitioned the Kano Court of Appeal to overturn the decision.

He stated that as a result, the Court of Appeal issued a decision on August 10, 2021, allowing the Appeal Court to set aside the Jigawa High Court’s decision, and the Supreme Court upheld the Appeal Court’s decision on October 14, 2021.

It was an act of mischief, he said, for people to think about the Supreme Court’s decision on March 24.

“Today, there was no such thing as a purported Supreme Court decision; there was no such thing as a Supreme Court decision.” There will be no new Supreme Court decisions.

“Today, the Supreme Court sat for less than 10 minutes to correct a clerical error on page 13 of the judgement delivered on October 14, 2021.”

” What was the clerical mistake? Edozie Njoku’s name was mentioned in the Jigawa Birnin Kudo High Court as having purportedly been suspended by the party, a fact alleged in the summons filed at the Jigawa High Court and dismissed by the Appeal Court Kano.

“So that clerical error was just on page 13 of the Supreme Court’s judgement, just one name, Edozie Njoku to replace my name there because my name was not mentioned at the Birnin Kudo High Court,” he explained.

“This is because I have never been suspended by anyone; I have always been the National Chairman of the party because I was duly elected at a national convention of the party held on May 31, 2019, in Akwa, which was monitored by INEC,” he explained.

He reiterated that on October 14, 2021, the Supreme Court upheld the decision of the Court of Appeal Kano, which affirmed him as National Chairman based on an Awka High Court decision that had not been appealed to date.

He claimed there was no basis for a new case because the Supreme Court upheld the Court of Appeal’s decision and denied all applications for joinder.

“It was dismissed, so there was no way the Supreme Court would have sat in judgement over its own judgement, because that judgement, as far as we are concerned, is Res judicata, it has been dealt with and is gone forever, so Njoku cannot be Chairman,”

Oye expressed dissatisfaction with some media reports on the issue that lacked clarification or balance, adding that the story indicating a new judgement was false. (NAN).
